Terms and Conditions

This document (together with the documents referred to in it) tells you information about us and the legal terms and conditions on which we supply any of the products (“Products”) listed on our website www.creationofnature.net (the “Site”) to you. Please read these terms and conditions carefully and make sure that you understand them before ordering any Products from the Site. You should understand that by ordering any of our Products, you signify your agreement to be bound by these Terms and Conditions which include our Privacy Policy.

You should save or print a copy of these Terms and Conditions for future reference.

We amend these Terms and Conditions from time to time as set out in clause . Every time you wish to order Products, please check these Terms and Conditions to ensure that you understand the terms which will apply at that time.

Your Status
By placing an order through our Site, you warrant that:
you are legally capable of entering into binding contracts; and
you are at least 18 years old.


Acknowledgement and Acceptance of your order
Please note that completion of the online payment process does not constitute our acceptance of your order.  Your order constitutes an offer to us to buy a Product.  After receiving your order, we will send you an order acknowledgement email as soon as possible detailing the Products you have ordered. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email that confirms that the Product has been dispatched (“Dispatch Confirmation”). The contract between you and us (“Contract”) will come into existence upon our sending you the Dispatch Confirmation.
The Contract will relate only to those products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Products has been confirmed in a separate Dispatch Confirmation.


Non-acceptance of your order may be a result of one of the following:
the product you ordered being unavailable from stock
our inability to obtain authorisation for your payment
error in pricing or product description
you not meeting the eligibility to order criteria set out in clause 2 above


Consumer rights
You are entitled to cancel your order from the time it is placed up to and within seven working days after the day on which you receive the Products. In this case, provided that the Products are returned in a satisfactory condition, as determined by us, you will receive a full refund of the price paid for the Products, excluding any delivery charges if applicable, in accordance with our Refunds Policy (set out in clause  below).
To cancel an order you must send us written notice of cancellation by email or post. You must also return the Products to us as soon as reasonably practicable, and at your own cost. You have a legal obligation to take reasonable care of the Products whilst they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.
We retain legal ownership of all Products until we have received full payment. We shall regain legal ownership of products automatically in the event that we refund payment to you.
Details of your statutory right of cancellation and an explanation of how to exercise it are provided in the Dispatch Confirmation. This provision does not affect your statutory rights as a consumer.


Availability and Delivery
All Products shown on our Site are subject to availability. We will inform you by e-mail as soon as possible if any Products you have ordered are not available. When Products are in stock, delivery can be expected within 2 – 5 working days of placing an order.
Your order will be fulfilled by the delivery date set out in the Dispatch Confirmation or, if no delivery date is specified, then within 14 days of the date of the Dispatch Confirmation, unless there are exceptional circumstances. In the event of delivery not being possible within 14 days of receiving the order, we will undertake to keep you informed of any changes and give you the option to cancel the order and receive full refund of monies paid.
We have a range of delivery options and timescales and charges will vary depending on the delivery option selected. Any delivery timescales are indicative only and do not constitute binding obligations on us.  Please note that we do not dispatch and deliver on Bank holidays, Saturdays and Sundays.

Risk and Title
The Products will be your responsibility from the time of delivery.
Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.


Price and Payment
The price of the Products and our delivery charges will be as per quoted on our Site from time to time, except in cases of obvious error.
Product prices and delivery charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.
We will normally verify prices as part of our dispatch procedures so that, where a Product's correct price is less than our stated price, we will charge the lower amount when dispatching the Product to you. If a Product’s correct price is higher than the price stated on our Site, we will normally, at our discretion, either contact you for instructions before dispatching the Product, or reject your order and notify you that we are rejecting it.
If the pricing error is obvious and unmistakable and could have reasonably been recognised by you as an error, we do not have to provide the Products to you at the incorrect (lower) price.
Payment for each order will be taken from your credit or debit card. We accept payment with MasterCard, Visa and American Express.  All card payments are subject to authorisation by your card issuer.  We will not charge your credit or debit card until we dispatch your order.
Our refunds policy
Creation of Nture by Ruta Ze, Inc. authentically ensures the purity and quality of our product line. Customers may request a product exchange, credit card refund or refund check for products returned due to allergy, dissatisfaction with product performance, defective product or product damaged in shipment. We do not refund or reimburse return shipping costs. Items must be received before the refund or exchange is processed.

Products purchased directly from Creation of Nature by Ruta Ze, Inc.:
If the item you wish to return was purchased directly from Creation of Nature by Ruta Ze, Inc. via the phone or our web site in the last 15 days then you may send the product back to us for refund or exchange. Products that have expired are not eligible for refund or replacement. We do not refund or reimburse return shipping costs. Items must be received before the refund or exchange is processed.
Please include the following with your return:
Reason for return
Customer Number, Name, Shipping Address, Billing Address and Phone Number
Let us know if you would like a replacement of the same product or if you would like the credit amount applied to an order of another item and we will be happy to process that order once we receive your return.
If you prefer a credit card refund please provide Credit Card number, expiration date and security code or we are happy to call you when we receive your return to collect that information
If you are requesting a refund check, please allow 4 to 6 weeks for processing and mailing of the check
Product purchased from a Creation of Nature by Ruta Ze, Inc. Authorized Retailer:
If you have purchased the product from a store, salon, spa or web site that retails Creation of Nature by Ruta Ze, Inc. Products we encourage you to contact that location directly to process your return. If you are unable to return the product to the location of the original purchase then you may be able to return the products to Creation of Nature by Ruta Ze, Inc.
We will accept return on product(s) that were purchased at an authorized Creation of Nature by Ruta Ze, Inc. Retailer* within the last 15 days. Credit or refund amount for products returned will not exceed the Suggested Retail Price set by Creation of Nature by Ruta Ze, Inc. Products that have expired are not eligible for refund or replacement. We do not refund or reimburse return shipping costs. Items must be received before the refund or exchange is processed.
Please include the following with your return:
Dated sales receipt, invoice or other proof of purchase
Reason for return
Name, Address and Phone Number
Let us know if you would like a replacement of the same product or if you would like the credit amount applied to the purchase of another item and we will be happy to process that order once we receive your return.
If you prefer a credit card refund, a dated sales receipt, invoice or other proof of purchase is required. Please provide Credit Card number, expiration date and security code or we are happy to call you when we receive your return to collect that information. If you are unable to provide a dated proof of purchase, we are happy to offer a credit towards the purchase of a replacement product or another product.
If you are requesting a refund check, a dated sales receipt, invoice or other proof of purchase is required. Please allow 4 to 6 weeks for processing and mailing of the check. If you are unable to provide a dated proof of purchase, we are happy to offer a credit towards the purchase of a replacement product or another product.for any other reason (for instance, because you have notified us in accordance with clause  that you do not agree to a change in these Terms and Conditions or in any of our policies, or because you consider that the Product is defective (which for the avoidance of doubt shall mean that the Product is damaged, of poor quality or not fit for purpose)), we will examine the returned Product to assess its defectiveness and will notify you of the status of your refund via email within a reasonable period of time. Where applicable, we will usually process the refund due to you as soon as possible and, in any case, within 30 days of the day we confirmed to you via email that you were entitled to a refund. We will refund the price of a defective Product in full, together with any applicable delivery charges and any reasonable costs you incur in returning the item to us.
We will usually refund any money received from you using the same method originally used by you to pay for your purchase.

We will process your return as quickly as possible, however, please allow up to 14 working days from the posting date for us to credit your account. We will notify you by e-mail once your return or replacement has been processed.
Warranty
We warrant to you that any Product purchased from us through the Site will, on delivery, conform in all material respects with its description, be of satisfactory quality, and be reasonably fit for all the purposes for which products of that kind are commonly supplied.
Our Liability
Subject to clause , if we fail to comply with these Terms and Conditions, we shall only be liable to you for the purchase price of the Products.
Subject to clause , we will not be liable for losses that result from our failure to comply with these Terms and Conditions that fall into the following categories: (i) loss of income or revenue; (ii) loss of business; (iii) loss of profits (whether direct or indirect); (iv) loss of anticipated savings; (v) loss of data; or (vi) waste of management or office time.
However this clause  will not prevent claims for loss of or damage to your physical property that are foreseeable or any other claims for direct loss that are not excluded by categories (i) to (vi) inclusive of this clause .
Nothing in these Terms and Conditions excludes or limits our liability for:
death or personal injury caused by our negligence;
fraud or fraudulent misrepresentation;
any breach of the obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982;
defective products under the Consumer Protection Act 1987; or
any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.


Written communications
Applicable laws require that some of the information or communications we send to you should be in writing. When using the Site, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.


Notices
All notices given by you to us must be given to Creation of Nature by Ruta Ze  at rutawellness@gmail.com. We may give notice to you at either the email or postal address you provide to us when placing an order, or in any of the ways specified in clause  above. Notice will be deemed received and properly served immediately when posted on our Site, 24 hours after an email is sent, or three days after the posting of any letter. In proving service of any notice, it will be sufficient to prove, in the case of a letter that such letter was properly addressed, stamped and placed in the post and in the case of an email that such email was sent to the specified email address of the addressee.


These Terms and Conditions, together with the Site Terms and Conditions and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of these Terms and Conditions.


We each acknowledge that neither of us relies on, or will have any remedies in respect of, any representation or warranty (whether made innocently or negligently) that is not set out in these Terms and Conditions, together with the Site Terms and Conditions or the documents referred to in them.
Each of us acknowledges and agrees that the only remedy available to it for breach of these Terms and Conditions shall be for breach of contract under these Terms and Conditions.  Nothing in these Terms and Conditions, however, operate to limit or exclude any liability for fraud.


Our right to vary these Terms and Conditions
We have the right to revise and amend these Terms and Conditions from time to time.
You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these Terms and Conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these Terms and Conditions before we send you the Dispatch Confirmation (in which case we have the right to assume that you have accepted the change to the Terms and Conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products).
